Defamation deals with damage to the reputation. The main purpose of defamation law is to protect the reputation. A defamation refers to an untrue statement of fact which causes the damage in forms of reputation loss. The untrue statements not merely cause the anger or the depression of the target person, but brings repetitional harm to them.

Freedom of expression is one of the indispensable parts of human rights. Expressing freely cannot only give a boost to the exchange of opinion, but also it can has a further impact on the development of human thoughts.

Article 19 of the International Covenant on Civil and Political Rights (ICCPR) states that “Everyone shall have the right to hold opinions without interference.” and “Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice.”

User-generated content is one of the characteristics of social networks. And social networks  allow the quick spread of all kinds of speech, whether protected or not. In order to prevent the dissemination of improper speech that is against the moral principles, social network sites should set guidelines for user-generated content that fit.

Once a defamation has been published via social network, it will spread rapidly. Either a gentle tapping on the screen of mobile phone or a  simple clicking on the mouse could be a boost for its unstoppable spreading.

Defamation has already extended to the Internet, and there is no difference between social media and other forms of publication in terms of defamation. If you defame anyone or any organisation on social media, you will be as liable as a specialist editor of any mainstream media outlet like newspaper or television.
